Welcome to Psydes, operated by Psydes LLC ("Psydes," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Psydes mobile application, website, collectible-card experiences, marketplace features, and related services (collectively, the "Services"). By creating an account, claiming a collectible, or using the Services, you agree to these Terms and our Privacy Policy.
Psydes connects physical collectible cards with digital and augmented-reality experiences associated with artists, creators, and other featured talent.
Access to particular digital content depends on recognition of the corresponding physical Psydes collectible or another authorized Psydes trigger. Different collectibles may unlock different content or experiences. If the required trigger is not recognized or is not available for a particular experience, that content will not be accessible.
In the current version of Psydes, content made available to collectors is selected, reviewed, approved, and published by Psydes in cooperation with the applicable artist, creator, or rights holder.
Collectors, artists, creators, and other third parties do not currently publish content directly into the live consumer app. Community posting, direct messaging, artist direct-publishing, and similar interactive publishing features are not currently available through the Services.
Psydes may introduce additional creator, community, messaging, or publishing features in future versions. If we do, those features may be subject to additional terms, content standards, moderation procedures, eligibility requirements, or privacy disclosures.
You must be at least 13 years old to create a Psydes account. If you are under 18, you must have permission from a parent or legal guardian to use the Services.
Certain collectibles or content may be designated as mature or explicit. Access to age-restricted content may be limited based on age, applicable law, platform requirements, or other eligibility controls.
Each Psydes collectible may include unique identifiers, claim credentials, recognition images, or other triggers used to associate the physical collectible with digital content.
While you are the verified holder of a collectible, Psydes grants you a limited, personal, revocable, non-exclusive, non-sublicensable right to access the digital experience associated with that collectible through the Services.
Owning a physical Psydes collectible does not give you ownership of the associated videos, photographs, music, artwork, text, likeness rights, trademarks, or other digital or intellectual-property content. Those rights remain with Psydes, the applicable artist or creator, and/or other rights holders.
Content and features associated with a collectible may vary over time. Possession of a collectible does not guarantee that every Psydes feature or every piece of content will remain available indefinitely.
A collectible may be claimed by one verified account at a time. Depending on the applicable feature, claiming may require scanning a QR code, entering a PIN, recognizing the physical card, or completing another verification step provided by Psydes.
Physical Psydes collectibles may be transferred or resold where permitted. When a collectible is validly transferred, the associated access entitlement may transfer to the new verified holder in accordance with Psydes procedures.
Marketplace functionality may be unavailable, limited, or changed while features are being developed or updated.
Physical Psydes collectibles may be offered through Psydes, participating artists, retailers, Shopify, or other authorized sellers. Prices, shipping terms, taxes, return policies, and other transaction terms may vary by seller and will be presented as applicable at the time of purchase.
Payment-card information may be processed by third-party payment or commerce providers. Psydes does not store full payment-card numbers.
You may not use the Services to:
Except for rights belonging to artists, creators, licensors, or other third parties, Psydes LLC owns the Services, including the software, functionality, interfaces, branding, designs, and related technology.
Artist and creator content remains owned by the applicable rights holder except where otherwise agreed in a separate written agreement.
You may not reproduce, distribute, commercially exploit, publicly display, republish, or create derivative works from protected Psydes or artist content except as expressly permitted by law or by the applicable rights holder.
Use augmented-reality features only in a safe environment. Remain aware of your surroundings and do not use AR features while driving, operating machinery, or engaging in activities that require your full attention.
Stop using AR features if you experience dizziness, discomfort, disorientation, or other adverse effects. Users under 18 should use AR features with appropriate parental or guardian supervision.
We work to keep Psydes available and reliable, but we do not guarantee uninterrupted or error-free operation, successful recognition of every physical card in every environment, or continued availability of every feature, artist, collectible, or piece of content.
We may modify, add, remove, suspend, or discontinue features or content, perform maintenance, introduce limits, or change technical requirements. Where practical, we will provide reasonable notice of material changes that significantly affect paid Services.
You may delete your account at any time through the Account settings in the app. Account deletion is permanent and cannot be undone.
Deleting your account may release collectibles associated with your account so they can be claimed by another eligible holder, subject to Psydes verification and transfer rules.
We may suspend or terminate access if we reasonably believe you have materially violated these Terms, used the Services unlawfully, attempted to defeat Psydes security or authentication, engaged in fraud, or created a material safety or operational risk.
Your use of Psydes is also governed by our Privacy Policy, which explains how we collect, use, disclose, and protect personal information.
To the maximum extent permitted by law, the Services are provided on an "as is" and "as available" basis. We do not guarantee that every physical image or trigger will always be recognized, that every experience will work on every device, or that the Services will be free from all interruptions or errors.
Nothing in these Terms excludes warranties, rights, or remedies that cannot lawfully be excluded.
To the maximum extent permitted by law, Psydes LLC, Psydes, and their officers, employees, affiliates, and service providers will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising out of or related to the Services.
Where liability cannot legally be excluded or limited, liability will be limited only to the extent permitted by applicable law.
We may update these Terms from time to time. For material changes, we may provide notice through the app, website, email, or another appropriate method. Continued use after updated Terms take effect may constitute acceptance where permitted by law.
These Terms are governed by the laws of the State of New York and applicable federal law, without limiting any mandatory consumer rights that may apply based on where you reside.
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
